| 1. The highest approved and acknowledged bidder shall purchase subject to reserve, and terms shall be strictly cash, bank cheque or cheque drawn by any Queensland-based building society or Queensland-based credit union/society payable to the Public Trustee, prior to delivery. If a successful bidder pays by cash in an amount of $10,000 or more, that bidder must provide all necessary personal details that will enable the public trustee to comply with its reporting obligations under the 'Financial Transaction Reports Act 1988'. 2. The purchaser may elect to pay the purchase price in full by 4pm on the day of the auction, or pay a deposit of $500 upon the fall of the hammer with the balance payable by 12 noon on the second business day following the sale. In addition to the purchase price, all buyers will pay $21.00 towards the cost of providing a security interest certificate (commonly called a "revs" certificate), pursuant to the 'property agents and motor dealers act 2000'. All prospective bidders are required to register their name and address with the auctioneer prior to bidding. Satisfactory evidence of identity must be provided. All registered bidders will be issued with a numbered bidder’s card. No bid will be accepted from any unregistered bidder. 3. Not withstanding condition 2, the auctioneer may demand any percentage of the purchase price as a deposit and resubmit a lot if this deposit is not paid immediately. 4. The highest bidder for a passed in lot has the exclusive right to negotiate until the end of the auction or any other time specified by the auctioneer. 5. The auctioneer shall determine any dispute absolutely, and his decision shall be final and binding. He may resubmit any lot at his discretion to resolve any error, dispute or default. He is not responsible for the recognition of alleged bids. 6. The vendor reserves the right to resell any lot in the event of default and to make good any loss including costs from a defaulter. There is no cooling off period on any lot. 7. The vendor shall have the right to bid, either by the auctioneer or by the vendor's agent, for any lot offered. 8. Written pre-auction bids will be accepted by the auctioneer if lodged no later than the commencement of the auction. The auctioneer will announce prior to each lot if any pre-auction bids have been received. A successful pre-auction bid will bind the bidder as purchaser to all of these conditions of sale. 9. All lots are to be taken with all faults, if any, and will be at the buyers risk upon the fall of the hammer & thereafter the vendor will be free of all responsibility for safeguarding the goods and will not be liable for any loss or damage to the goods sold. 10. All vehicles are sold by lot number, and a roadworthy certificate and safety certificate are provided with each lot except those sold for wrecking, renovation or repair or alteration. No refunds will be made for missing tools etc. 11. All relevant dates are given in reference to the australian compliance plate for each vehicle. 12. The auctioneer may, without giving any reason therefore, refuse to accept the bid of any person or withdraw any lot from the sale. 13. The auctioneer is not responsible for the correct description of, or any fault or defect in any lot and makes no warranty whatever. 14. All lots having been available for inspection, no allowance or refund will be made nor may any buyer reject a lot because of alleged mis-description. Any error made in describing the vehicle including year of make and model shall not violate the sale, but the purchaser shall be bound to take the goods sold provided the sample has been shown. Lots are sold subject to all faults (if any). 15. Members of the public attend at their own risk. No responsibility is accepted for any accident. 16. Delivery is not to be taken without a representative of the vendor being present at the time. 17. Time is to remain the essence in regard to these conditions. 18. No waiver of these conditions will be valid unless in writing by the Public Trustee. 19. If GST is payable in respect of the supply of
